Car Accident Injuries

A car accident can cause minor or catastrophic injuries. Such injuries will vary depending on the location and force of impact, the crash worthiness of the vehicle, whether the victim was wearing a seatbelt, and other factors, with some victims sustaining trivial injuries in severe accidents and others experiencing debilitating trauma in seemingly minor collisions.

The following are injuries that may be caused in a car accident:

  1. Whiplash and other neck injuries
  2. Broken bones
  3. Internal organ damage
  4. Head trauma
  5. Spinal cord injuries
  6. Burn injuries
  7. Severe cuts and bruises
  8. Facial trauma

It is important to seek medical attention after any auto accident, even if you feel that you have not been seriously injured. Whiplash and other injuries may not become evident or painful for hours or even days following the collision, and a doctor can help you avoid exacerbating the injury (not to mention provide a paper trail of treatment you have pursued, which can help you obtain a fair recovery).

Types of Compensatory Damages

In California, compensatory damages are intended to compensate a person for their losses and can include both economic damages and non-economic damages.

  1. Economic Damages - these types of damages cover tangible expenses like medical bills, property damage, transportation costs, lost wages, etc.
  2. Non-Economic Damages - these types of damages cover intangible losses like pain, suffering, scarring, anxiety, emotional distress, grief, loss of limb or organ, etc.

If you've been seriously injured in an auto accident, it is likely that you are eligible for both types of compensatory damages. Schedule a free case evaluation with our law firm and we can help you determine what your best legal options are moving forward.

How Long Do I Have to File a Claim?

According to the California Code of Civil Procedure section, 335.1 the statute of limitations to file a personal injury claim in California is two years. This means you have two years from the date of your accident to file a claim or you may lose your right to pursue compensation.

If your claim is against a government employee or entity the statute of limitations changes from two years to six months. California does recognize some exceptions to this two-year rule depending on the specifics of your case. An experienced attorney from our firm will be able to let you know if you qualify for an exception to extend the statute of limitations.

Auto Accident Fatality Statistics in California

Car accidents are a serious issue and a leading cause of death in the United States. A 2016 report from the California Office of Traffic Safety provided the following information:

  1. In California, there were 3,623 fatal vehicle accidents in 2016.
  2. In 2016, 15% of all fatality victims tested positive for legal and/or illegal drugs.
  3. There were 1,059 DUI-related fatalities in 2016.
  4. In 2016, there were 110 teen driver fatalities, an increase of 12.3% from the previous year.

The main takeaway from this report is that fatal motor vehicle accidents are on the rise in California.
